1. Who we are

EVintiques (“we”, “us”, “the marketplace”) operates an online marketplace at evintiques.shop where independent dealers list antiques, vintage pieces and collectibles for sale to buyers across the UK and beyond. By using the site you agree to these terms.

2. Our role — we are the marketplace, not the seller

This is the most important thing to understand about how EVintiques works. When you buy a piece, your contract of sale is directly with the independent dealer who listed it, not with EVintiques. We provide the platform that connects you, process the payment, and help where we can — but the dealer is the seller and is responsible for the piece, its description, and getting it to you.

Where these terms refer to “the seller” or “the dealer”, that means the independent business you bought from.

3. The pieces

• Almost everything on EVintiques is one of a kind. Once a piece is sold, it is gone — listings describe a single specific item, not a product line.
• These are antique, vintage and second-hand goods. They carry age, wear and character. Dealers describe condition honestly, and the photographs form part of the description — please read and look closely before buying.
• Prices are set by each dealer and shown in pounds sterling. Delivery is arranged separately (see section 6).

4. Buying

1. Add a piece to your basket and check out. Placing an order is an offer to buy from the dealer.
2. Payment is taken at checkout through our payment provider, Stripe. We never see or store your full card details.
3. A contract is formed when the dealer accepts your order. If a piece turns out to be unavailable — for example it sold elsewhere before the listing updated — the dealer will decline and you will be refunded in full.

5. Prices and payment

• The price you pay is the price shown at checkout. Dealers are responsible for pricing their own stock.
• If your card is issued outside the UK, your bank or our payment provider may show the amount in your local currency and apply a conversion fee. That conversion is between you and them.
• Card payments are handled securely by Stripe under their own terms.

6. Delivery

Delivery is arranged directly between you and the dealer. Many antiques are large, fragile or valuable, so the dealer will agree carriage, collection or specialist shipping with you after purchase. Delivery times, costs and methods are the dealer’s responsibility, not ours. Risk in the piece passes to you on delivery.

Paid pieces must be collected within 7 days of purchase unless another delivery or collection arrangement has been agreed with the dealer. A dealer may charge reasonable holding or storage fees for a paid piece left beyond that period. Storage can be arranged directly with the dealer where needed.

7. Returns and cancellations

Your rights to cancel and return are set out in full in our Returns & Cancellations policy, which forms part of these terms. In short: as a consumer buying at a distance you usually have a 14-day right to cancel, with some exceptions, and you always have rights if a piece is not as described.

8. Selling on EVintiques

If you register as a dealer, you additionally agree that:

• You are a genuine trader with the right to sell the pieces you list.
• Your listings — descriptions, photographs, condition and provenance — are accurate and not misleading. You are responsible for them.
• You will fulfil orders promptly, arrange delivery in good faith, and deal fairly with buyers, including on returns where the law or these terms require it.
• You hold an active subscription plan to list pieces. Plans, commission and payouts are governed by your dealer agreement and the plan you choose at sign-up.
• You will not list counterfeit, stolen, unlawful or misrepresented goods.

We may remove listings or suspend an account that breaches these terms, and we act as an intermediary in disputes but are not a party to the sale itself.

9. Your account

Keep your login details secure and let us know if you think your account has been used without your permission. You are responsible for activity under your account.

10. Our liability

Because the sale is between you and the dealer, the dealer is responsible for the piece and its delivery. We are responsible for operating the marketplace with reasonable care. Nothing in these terms limits liability that cannot be limited by law — including for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for the acts of dealers or buyers, or for indirect or unforeseeable loss.

11. Changes and governing law

We may update these terms; the “last updated” date shows when. Continued use means you accept the current version. These terms are governed by the law of England and Wales (or, where you live elsewhere in the UK, the law of your home nation), and the courts of that jurisdiction have non-exclusive jurisdiction.
